Criminal Law

Criminal Defense
Assault and battery can be tried under criminal law or civil law or both. In criminal courts, assault and battery have to be proven to the standard of "beyond a reasonable doubt".
DUI/DWI
DUI (Driving Under the Influence) or DWI (Driving While Intoxicated) laws are names for the same offenses in different states. We'll use the term DUI since this is more common than DWI.
Wrongful Death
Wrongful death lawsuits are becoming more common. Wrongful death lawsuits are brought forth because the plaintiffs believe the death of a loved one was brought about by negligence or liability by the defendant or defendants.
Sex Crimes
Most of the clergy sexual abuse lawsuits against Catholic priests have involved molestation of a minor. When George Weigel broke a news story in 2002 concerning clergy sexual abuse by ordained priest John Geoghan, this started a wave of allegations and lawsuits and would become the number one Catholic church scandal for the next five years.
Robbery
False imprisonment is defined as the act of intentionally confining a person without the legal authority to do so. Some scenarios that may include false imprisonment are the taking of hostages during a bank robbery or the detainment of a customer by the business owner for failure to pay the bill.
Theft
Assault
Assault and battery are legal terms where assault is the threat of doing bodily harm and battery is the infliction of unwanted touching (battering), though physical injury is not necessary in order to prove battery. Insulting or provocative words without threat, no matter how repugnant, do not constitute assault.
Murder
If the alleged defamer spoke or wrote fallacy instead of fact, fiction and falsehood instead of commonly accepted evidence, then this in and of itself is not defaming without malice. Malice aforethought is a legal term usually used to convict someone of first-degree murder. It means someone had cognizant intent before committing a crime. With defamation of character, this kind of malice must be proven as well.
Shoplifting
The majority of cases of false arrest are cases involving shoplifting and are held against private security companies and stores. A security guard working for a private security company does not have the authority to arrest someone based on a suspicion that the person is likely to commit a crime. In most cases, there must be some proof that the illegal act has already been committed. For instance, the person must actually try to exit the store without paying for the items they have stolen.
